Terms and conditions

01Booking and the shoot

1. 1.1Book by email or WhatsApp. Partner agents also get their own booking link. We aim to book your shoot within 3 working days, and confirm the date and time by email.
2. 1.2The agent is responsible for access to the property, for telling the vendor or tenant the shoot is happening, and for giving us accurate property details.
3. 1.3We photograph the property as we find it on the day.
4. 1.4Shoots run 9am to 5.30pm, Monday to Friday. Evening, weekend and twilight shoots are available on request at an extra charge.
5. 1.5Drone work follows Civil Aviation Authority rules and flies only when wind, rain and airspace allow. The Showcase and Accelerator Packages include a free drone revisit. The Essentials Package does not, so a revisit costs £40 if the agent wants one. This applies unless otherwise agreed or specified before the shoot. A revisit delays content delivery.
6. 1.6If airspace rules mean a drone cannot fly at the property at all, we will not charge for the drone part of the booking.
7. 1.7Shoots more than 25 miles from HX1 5ER carry a mileage charge at the HMRC approved rate, currently 55p per mile, for each mile beyond that. Mileage is a round trip by the quickest route. We will tell you before we book.
8. 1.8If the property is larger than booked, or differs from the details we were given, we may charge the difference at our standard rates.

02Cancellations and no-shows

1. 2.1Changes made more than 24 hours before the shoot are free. Inside 24 hours, rescheduling costs £25 and cancelling costs £50.
2. 2.2If we arrive and cannot get in, or the property is not ready, the £50 fee applies and a new visit is booked.
3. 2.3If we have to cancel because of illness, equipment failure or events outside our control, we will rebook at the earliest available date. We are not liable for any other costs this causes.

03Delivery and amendments

1. 3.1All content (photographs, floorplans and film) is delivered within 2 to 3 working days of the last content being captured.
2. 3.2One round of amendments is included if requested within 7 days of delivery. Further rounds cost £45 plus VAT per video and £5 plus VAT per image.
3. 3.3If a photograph falls short of our standard through our own error, we will reshoot it free of charge, if you ask within 7 days of delivery. Weather, presentation and changes to the brief are not covered.
4. 3.4Extra visits needed because of changes on your side are charged as a new shoot.
5. 3.5Floorplans are measured with a LiDAR scan, with a tested average accuracy of 95 to 97%. Plans and areas are for guidance only and should not be relied on for valuation or legal purposes.
6. 3.6We never remove permanent features, such as lamp posts, or anything a buyer would notice on the doorstep. Any sky replacement is disclosed. The agent is responsible for checking the final listing is accurate.
7. 3.7We keep your files for 12 months after delivery. Raw, unedited files are not supplied.

04Payment

1. 4.1The agent who books the shoot is responsible for paying the invoice in full. This applies even if the agent expects the vendor to pay, passes the cost on, or asks us to invoice the vendor.
2. 4.2If the vendor does not pay within 14 days of the invoice date, the agent must pay the full amount within 7 days of our request. This responsibility cannot be waived or passed to anyone else unless we agree in writing.
3. 4.3All prices are plus VAT. Payment is due within 14 days of the invoice date.
4. 4.4We may charge interest and recovery costs on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.
5. 4.5Commercial and bespoke work is quoted in writing before we book. Quotes are valid for 30 days.
6. 4.6We may change our prices with 30 days’ notice. Shoots already booked keep the price agreed.

05Copyright and licence

1. 5.1Copyright in all photographs, film, floorplans and drone footage stays with HSP Collective Limited.
2. 5.2Once the invoice is paid in full, the agent holds a licence to use the media to market that property for as long as it is listed with them.
3. 5.3The licence cannot be passed to the vendor, a new agent or any other party without our written consent. Fees for a transfer are available on request.
4. 5.4If an invoice is overdue, the licence is suspended. The media must be removed from all portals, websites and social channels until it is paid.
5. 5.5We may use the media in our own portfolio and marketing. We never show house numbers, faces or personal details. By booking, the agent confirms the vendor has agreed to this.

06Liability and general

1. 6.1Our total liability for any booking is limited to the fee paid for that booking. Nothing limits liability that cannot be limited by law.
2. 6.2We are not liable for indirect loss, such as a lost sale, lost commission or a delayed launch.
3. 6.3We hold public liability and professional indemnity insurance, including cover for accidental damage at the property. All our staff are CAA certified, with a CAA Operator ID and Flyer ID for drone flights.
4. 6.4HSP Collective Limited is registered with the Information Commissioner’s Office (ICO). We handle personal data in line with UK GDPR.
5. 6.5We may update these terms. The version in place on the day you book applies to that booking.
6. 6.6These terms are governed by the law of England and Wales. By booking a shoot, you are accepting these terms.

07Homeowners and landlords

1. 7.1These terms also apply when a homeowner or landlord books us directly. Nothing in them affects your statutory rights as a consumer.
2. 7.2Payment is due in full when you book.
3. 7.3You can cancel within 14 days of booking for a full refund. If you ask us to shoot within those 14 days, you pay for any work already done. Once your content is delivered, the right to cancel ends.
4. 7.4Where these terms refer to the agent, they mean you. Your licence in clause 5.2 lasts for as long as you market or let the property.
5. 7.5Clause 4.4 does not apply to you. Clauses 6.1 and 6.2 apply only as far as consumer law allows.
